1. THE PURPOSE OF THIS CONTRACT IS TO REGULATE THE CONDITIONS APPLICABLE TO THE CONTRACTING, USE AND CANCELLATION OF SERVICES AND BENEFITS OFFERED BY NEWSKY SPECIFIC (“SERVICES”) THROUGH A MONTHLY SUBSCRIPTION. PLEASE READ THE TERMS AND ALL CONDITIONS BELOW CAREFULLY. IF YOU DO NOT AGREE, IN WHOLE OR PART, WITH THESE TERMS, AS WELL AS WITH ANY ADDITIONS, CHANGES OR UPDATES, THE CUSTOMER WILL NOT BE ABLE TO ACCESS THE SERVICES.

4. PURCHASE OR RENTAL OF THE ROUTER DEVICE MÔNICA WIFI

IF IT IS PURCHASED OR RENT, AND VALUES.

The MÔNICA WIFI ROUTER DEVICE is rented and must be returned at the end of the contract. The device is already configured and ready for use and any type of alteration or adjustment to the device settings is prohibited.

PREMIUM KIT: POWER CHARGER, USB CABLE and an EXCLUSIVE NEWSKY BAG. The customer is allowed to enjoy the premium kit as long as he is an active subscriber to the service. The Premium Kit is borrowed and must be returned at the end of the contract.

LOSSES AND DAMAGE TO THE MONICA WIFI ROUTER:

Loss or damage to the device: ¥12,000, for active contracts, in use.

Loss or damage to PREMIUM KIT: ¥3,000.

If you lose your device, you can buy another one or rent one. In this case, the prices will be those offered at the time. Consult us!

Loss: It will be considered 'loss' when the damage to the device MÔNICA WIFI ROUTER makes it impossible to use, interferes with important functions, if the device is aesthetically with marks that de-characterize the product, if it is not returned or is lost.

Damage: It will be considered 'damage' when the ROUTER MÔNICA WIFI device has any mark that is only light visual, that does not detract from the product, and does not prevent normal use.

This analysis will be exclusively carried out by NewSky or the person in charge chosen by NewSky, and any type of analysis by third parties will not be accepted without proper authorization.

The rented MÔNICA WIFI ROUTER must be returned no later than the 5th of the month in which you do not wish to use the service, with a daily fine of ¥500 for delay in returning from the 6th.

Non-return of the MÔNICA WIFI ROUTER device when canceling the contract: ¥25,000 fine + other applicable fees.

Failure to return the MÔNICA WIFI ROUTER device and, or non-payment of the monthly fee until the 20th, will be considered abandonment of contract and will be canceled.

If you count internet usage in the month you do not wish to use the service, the full amount of the monthly fee must be paid.

5. PAYMENT METHODS

PAYMENT DATE

PAYMENT WILL BE DEBITED MONTHLY BY THE 5TH. 

Please ensure you have sufficient balance on your credit/debit card one business day prior to this payment date.

PAYMENT MUST BE MADE MONTHLY BY THE 10TH.

    A. If payment is not made within the deadline, the signal will be suspended. In addition, a fee of ¥1,000 will automatically be levied on the monthly fee. We recommend that you always pay on time.
    B. If cut due to non-payment, the signal will be reactivated within 3 working days after confirmation of payment by our payment center.
    C. If you do not make the payment by the 20th, your contract will be understood as abandonment by the customer and will be canceled. Outstanding amounts must be paid immediately.
    D. If you wish to change the Smart Pit payment method to a credit card or vice versa, the customer must contact our call center at least 30 days prior to the payment date.
    E. The ¥220 [konbini/credit card] billing fee is currently being paid by NewSky, but may be added to the invoice at any time without notice. Service pending issues will be deducted via credit card (registered) or Smart Pit charge.

6. CHANGE OF PLAN

    A. To request the change of plan, make the request with our central until the 20th so that the change is made for the next month. Plan switching fee amount is ¥3,300 and you can choose from available plans. The change will take effect from the first day of the following month. 

7. CANCELLATION

ANNUAL CONTRACT

NO CANCELLATION FEE

    A. Step 1: To cancel the service, the holder must contact NewSky by the 5th of the current month and request the cancellation of the service for the same month. After the 5th, the cancellation will be processed the following month.
    B. Step 2: The customer must pay the amounts owed to NewSky within the stipulated period.
    C. We will charge the fine through Smart Pit or credit card, according to the contracted plan.

      For Smart Pit or credit card billing, once the charge is posted, if there is a need to post a new charge or change the payment date, there will be a fee of ¥1,000 added to the fine.

    D. CONTRACT WITH RENTAL DEVICE: THE DEVICE MUST BE RETURNED BY THE 5TH OF THE MONTH THAT YOU DO NOT WANT TO USE THE SERVICE, WITH A DAILY FINE OF ¥500 FROM THE 6TH UNTIL THE DATE OF RESOLUTION OF PENDING OR RECEIPT OF THE DEVICE AT OUR CENTER. IF USAGE IS ACCOUNTED, THE MONTHLY FEE MUST BE PAID.
    E. With the non-payment of the monthly fee until the 20th of the month of payment, and the lack of interest or lack of communication with NewSky, the fines regarding to the clauses not complied with by the customer will be applied, which will be charged by our legal representative, Libra Legal Office and/or Trade's Creditor Protection Co.ltd. being from that moment responsible for the case and, according to the case, a case will be opened in the court of justice in the jurisdiction of Tokyo.The documents and general information will be used for resolution by legal means and in addition, your name may also be registered with the CREDIT PROTECTION SERVICE in Japan and abroad. Any legal disputes will be resolved with the Tokyo Court of Justice.

8. CONTRACT, DATA TRAFFIC & SUSPENSION RIGHTS

    A. Please be advised that as of January 2016, Japanese data traffic control laws have been tightened. New rules from operators or the government may occur without prior notice. Restrictions on the volume of data traffic may apply.

    B. We provide adequate data capacity for general use, but from a fair usage and network quality maintenance point of view, usage restriction may apply to users communicating in large quantities, downloading large files, very long videos, etc. In these cases, measures can be taken, such as interrupting the communication or greatly decreasing the communication speed.

    C. Customers who consume large amounts of data need to be careful. * Will not be refunded or exchanged, etc. in case suspension measures or speed restrictions are applied by the operator or the government. NewSky is not responsible for signal failures in some areas.

    E. In case of delay or abandonment of a service contract, if the customer has another active service, NewSky reserves the right to suspend the other service without prior notice.

    F. NewSky reserves the right to unilaterally suspend or cancel the customer's contract, if it causes damage to the company or in case the company deems misuse or misconduct on the part of the customer, without prior notice and without compensation.

    G. We recommend that you do not make any changes to the router's settings, the device is already configured and ready for use.

    H. In case of suspension of the service due to accidents or unscheduled maintenance, there will be no reimbursement for the time of service unavailability.

    I. NewSky reserves the right, in case of any change in the service by the operator, to pass on this change to the customer without prior notice, complying with the rules required, including price readjustments. J. The maximum communication speed of the device and service are maximum values ​​based on technical standards and do not necessarily represent speeds in actual use. Internet speeds while in use may vary due to user environment (such as terminal device specifications) and network congestion.

    H. The collection of pending or debts can also be done abroad. The customer may have his name included in the SPC (credit protection service).

    K. 14.5% interest will be charged per year on amounts and pending issues not settled with NewSky, whether in arrears, cancellation fines, or any other pending issues that the customer has with NewSky.

10. DOCUMENTS

    A. It is the customer's responsibility to keep documents and registration data always updated with NewSky. NewSky communicates with customers via SMS, Facebook, WhatsApp, email or telephone.

11. SUPPORT & CONTACT

    A. NewSky does not support and is not responsible for software and applications used by the customer.

    B. Service for technical support or questions regarding late payment will only be resolved within the business hours of the responsible department: Monday to Friday from 10:00 am to 5:00 pm (closed on weekends and national holidays).
